Can I get an extension on a TCPA demand letter deadline?

Usually, if you ask in writing before the date, give a reason, and propose a new date. Suppress the listed numbers first; a request that arrives while the dialer is still running lands badly.

Usually, yes. The deadline is the sender's, set to move the matter along, and most senders will grant a short extension to a business that asks properly. Properly means four things: in writing, before the date, with a reason, and with a proposed new date. A request with no reason, or one that arrives after the date, is weaker but still worth sending. The date on the letter is the sender's clock, not the law's; see what is the statute of limitations for a TCPA claim.

What the request contains

  • The matter reference from the letter.
  • Confirmation that every listed number has been suppressed in every system, with the date.
  • The reason: records requested from a vendor, a coverage position pending from an insurer, counsel engaged and reviewing.
  • The date by which you will respond substantively.

Nothing about the facts. "We never do that" or "the vendor handles all of this" are statements about the calls, made before you have checked, and they live in the sender's file forever.

While you wait

The extension buys time to decide, not time to carry on. Calls to the listed numbers after the letter are knowing calls, the ones a court can treble to $1,500, and an extension does not change that. Use the time to pull the logs, get the vendor's consent records, and have the first conversation with a lawyer. Get the new date confirmed in writing and treat it as firm; a second extension is harder to get than the first.

People also ask

What is a good reason to ask for time?

Waiting on records from a vendor or lead generator, waiting for an insurer’s coverage position, or a lawyer’s first availability. All ordinary, all credible.

Should I say anything about the calls in the request?

No. Confirm the reference, say the numbers have been suppressed, give the reason and the date. The facts come later, with records.

What if the deadline already passed?

Reply anyway. Say what you have done since the letter arrived and ask whether the demand-stage figure is still available. Many senders will engage if the matter has not yet been referred.
